About the Mandate Process

IMPORTANT

It is important at this time that you have determined that the employee will lose his/her job should they not complete an
evaluation through the EAP. This fact alone distinguishes a manager mandate from a regular supervisory referral. If you
are concerned about an employee’s behavior, and it has just begun to affect his/her work performance, but not to the point
of termination, you may wish to speak with this employee about your concerns. Then, strongly recommend that he/she seek
assistance through the EAP or company insurance policy. If the employee chooses not to contact the EAP, and their work
performance declines to the point where termination could occur, you may wish to mandate that employee. Remember to keep
documentation of the violations, and keep in mind that resorting to mandating an employee means that they will be fired
should they not contact and follow recommendations by an EAP credentialed counselor. This is considered a last chance.

If you decide to Mandate, follow the procedure below:

  • Supervisor and/or Human Resources should meet with the employee to discuss the situation.
  • The supervisor needs to fill out the Mandate Information Sheet. This
    form is to be reviewed with the employee and then faxed to the EAP Account Management Staff at (717) 901-5659. This
    form is forwarded to the counselor to help focus on the specific issues requested by the supervisor.
  • The supervisor also needs to fax the “Condition of Continued Employment” (COCE).
    This must be signed by both the employee and the supervisor. This agreement states that the employer is mandating the employee to have an evaluation done through the EAP or may otherwise be terminated.
  • NOTE – EAP Account Management MUST HAVE a signed COCE before we can communicate to a supervisor that the mandated employee called the EAP. The person or people to whom we can communicate otherwise confidential information must ALSO sign the COCE with the employee.
